Terms of Service
General Guidelines
* Artist has the right to decline and refuse a commission or artwork.
* The terms may vary depending on the type of commission.
* The Timeline must be discussed and specified before beginning the commission.
* Artist may use commercially licensed, copyright free assets/ materials.
* Client provides complete requirements and clear expectations upfront.
* Client grants to the Artist non-exclusive rights to observe and replicate Client’s own character design, reference material and other intellectual property for the use of the Work.
* Client warrants that the intellectual property provided to the Artist are legally obtained and authorized for use by the Client.
The Artist’s work CAN NOT be used
for AI or as NFTs
Confidentiality
The Artist and Client both acknowledge that any information and materials shared and provided such as personal information, payment information, marketing plans, and other sensitive information shall be considered confidential. The information shall not be disclosed to the public or to any other without consent and written permission.
Payment
* Payment terms must be clearly outlined. Mode of payment, Account, Commission costs, and Installment plans, must be settled.
* A Down payment, a minimum of 30% of the price, is required before proceeding with the commission.
* Extra characters, backgrounds, and other additionals will be charged.
* If Paypal, then payment is accepted through invoice
* If Paypal, payment must be in USD
* The Artist will send the invoice once they are ready to begin the work.
* The Client must not send money before this.
* Invoices must be paid within 2 days. The commission will be cancelled if there is no response.
By accepting payment through invoice, you agree that you are paying for a digital product. And that the account, and by extension, the money is yours or have been given permission to use. You agree to not chargeback.
Refund is available IF;
* The Artist is unable to complete the commission.
* If the commission is still incomplete four weeks after the deadline unless and extension has been discussed between artist and client.
* If the commission is cancelled, then the commissioner shall receive a full refund if the commission has not yet begun. 50% shall be refunded provided a 2 days’ notice once work has begun. No refunds will be available after that.
Copyright and License
Artist's Rights
The artist retains copyright, ownership, redistribution, and intellectual property rights. This includes, but is not limited to, display, advertising, printing, the output and output in progress on social media, portfolios, websites, and more.
The artist may use rejected work in progress or other versions for other works according to their discretion, provided it does not infringe upon the Client’s intellectual property rights and ownership of their likeness, character design, or other trademarks.
The artist retains non-exclusive rights to sell prints or other forms of merchandise of their work, unless the Client has exclusive rights.
Client's Rights
Clients must not claim the output as their own and must credit the Artist using their designated tag or name. Client must not erase the Artist’s signature or watermark.
Clients receive non-transferable usage rights to the output for personal use. The output can be used as display, provided it is not used for monetization.
Commercial Rights
Commercial usage rights are to be discussed by the Artist and Client.
In the case of designs for the Client’s identity such as character design, intellectual property rights of the design and their likeness are exclusively granted to the Client for
